STR Regulations for Guaynabo, Puerto Rico

Overview: Are short‑term rentals allowed in Guaynabo?

Short‑term rentals (STRs) are allowed in Guaynabo under Puerto Rico’s general rules. Guaynabo has not enacted city‑specific STR ordinances; therefore, hosts operate under Commonwealth‑level requirements (e.g., Puerto Rico Tourism Company registration and room tax) and standard building/safety codes enforced through the centralized permitting system. In practice, the market exhibits low regulatory friction, which benefits operators. Sources: AirROI Guaynabo market report; Checkmate Rentals – Guaynabo page.

How to start a short‑term rental business in Guaynabo (PR)

  • Step 1 – Confirm use and zoning: Confirm the property’s zoning allows transient accommodations (OGPe or municipal planning office).
  • Step 2 – Entity and tax backbone: Form a legal entity (e.g., LLC) and obtain Puerto Rico Merchant Registration from the Treasury Department (Registro de Comerciantes).
  • Step 3 – Innkeeper registration: Register with the Puerto Rico Tourism Company (PRTC) as an innkeeper (“hostalero/hostelero”) to obtain a Room Tax ID.
  • Step 4 – Single Permit (Permiso Único) through OGPe:
    • File for the Single Permit that consolidates the Use Permit and related health/fire/environmental certifications (fire prevention certificate, sanitary license, and environmental compliance by categorical exclusion, as applicable).
    • Submit property deed/lease, merchant registration, property plans/sketches, and required compliance certificates.
    • Budget for government fees; plan processing time and anticipate follow‑ups.
  • Step 5 – Taxes and accounting:
    • Collect and remit the 7% room occupancy tax on rentals under 90 days.
    • Maintain robust records (bookings, income, expenses) for income tax and PRTC filings.
  • Step 6 – Insurance and risk: Secure host liability insurance and confirm your homeowners or property policy includes short‑term rental coverage.
  • Step 7 – Platform listing: Optimize listing (photos, amenities, policies), include your PRTC registration number and room tax ID in the listing, and ensure accurate depictions of occupancy, parking, and rules.
  • Step 8 – Operations: Establish cleaning, maintenance, and guest communications SOPs; set pricing strategies aligned with Guaynabo’s seasonality (peak: March/August/December; low: September–November). Sources: Christie’s PR STR Guide (permits, PRTC, OGPe, 7% tax).

Specific regulations (Guaynabo city/municipality, county‑equivalent, and PR state)

  • City/municipality (Guaynabo): No Guaynabo‑specific STR ordinance has been identified. No separate municipal STR license is required to operate, beyond the general Commonwealth process.
  • State/Commonwealth (Puerto Rico):
    • STRs are defined as rentals under 90 days.
    • PRTC innkeeper registration and Room Tax ID are mandatory.
    • 7% room occupancy tax applies and must be collected and remitted.
    • Single Permit (Permiso Único) administered by OGPe consolidates use and safety/health/environmental clearances.
  • Comparable municipal framework (San Juan): San Juan requires a separate municipal STR license for rentals < 90 days ($100/year shared units; $500/year non‑shared units). This does not apply in Guaynabo but illustrates the type of regime Puerto Rico municipalities can adopt. Source: San Juan STR ordinance overview (for context only).

Notes and practical cautions

  • Taxes: Verify whether your booking platforms collect/remit the 7% room tax to PRTC on your behalf; coordinate filings to prevent double collection or penalties.
  • Documentation readiness: Organize property deeds/leases, merchant registration, plans, safety/health certificates before applying to OGPe to reduce processing delays.
  • Monitoring: Track municipal updates; some Puerto Rico municipalities have added or are considering STR ordinances, and Guaynabo could follow.
  • Compliance discipline: Even in a low‑regulation environment, maintain strict adherence to PRTC requirements, safety codes, and community standards to safeguard your license and reputation. Sources: Christie’s PR STR Guide; Checkmate – Guaynabo.
