STR Regulations for Evansville, Indiana

Are short-term rentals allowed in Evansville?

Evansville, Indiana permits short-term rentals (STRs) under current state and local frameworks. Indiana law (House Bill 1035/1036) prohibits municipalities from banning vacation rentals, though cities can regulate them through permitting, safety, and zoning tools. As of 2025, Evansville does not have a city-specific STR ordinance in its municipal code, and the city does not operate a dedicated short-term rental permitting system. The city does maintain a general “Rental Property Registration” for long‑term rentals ( Ordinance G-2014-29), but this is not a short‑term rental license.

However, a 2026 outlook article projects a more structured registration/licensing regime, including possible background checks, property inspections, and a capped application fee of $150 (mirroring Indiana’s statewide cap for initial permits). These proposals are not currently codified and should be treated as directional rather than enforceable until confirmed by the city.

Bottom line: Yes—STRs are allowed today under general state and local rules; prepare for potential new requirements in 2026 that may introduce a registration/licensing pathway.

How to start a short-term rental business in Evansville

  • Research zoning and land use

    • Confirm that STR use is allowed on your parcel. Even without a dedicated STR code, residential/commercial zoning and HOA/cc&r constraints still apply. For properties governed by community associations, obtain written approval before listing.
  • Secure tax registrations and compliance

    • Register with the Indiana Department of Revenue to collect/remit the 7% state sales tax on accommodations under 30 days.
    • Verify county-level lodging (innkeeper’s) tax obligations (typically remitted through the Indiana Department of Revenue portal for state-administered local taxes).
    • Maintain accurate records of nightly rates, cleaning fees, and total charges to ensure precise reporting.
  • Obtain insurance appropriate for commercial STR use

    • Standard homeowners policies often exclude short-term rental activity. Carry property and liability coverage tailored to STR operations. Platforms’ host protection programs have gaps and should not be your sole coverage.
  • Implement safety and maintenance standards

    • Equip units with working smoke detectors, carbon monoxide alarms where applicable, fire extinguishers, clearly posted emergency egress information, and any additional items required by local code or insurers.
    • Establish and document cleaning, maintenance, and turnover protocols to manage compliance, guest safety, and property condition.
  • Designate local point of contact and operations

    • Identify an on-call contact for emergency response and complaint resolution. Where owner is out of market, contract with a local property manager. Document response times, issue escalation, and guest communication practices.
  • Guest screening and operational policies

    • Define guest criteria, maximum occupancy, quiet hours, parking rules, and community standards. Include house rules in listings and guest agreements.
  • Platform setup and revenue controls

    • Publish listings on your chosen channels, implement dynamic pricing, and set channel manager workflows for calendar, messaging, and payment reconciliation.

Required documents, permits, licenses, and guidelines

  • Current state and local requirements

    • Business/tax registration: Indiana Department of Revenue registration for 7% state sales tax on transient lodging.
    • County lodging tax: Registration and remittance through the state’s portal where administered locally; confirm your specific rate with local authorities.
    • General liability and property insurance appropriate for STR use (evidence may be requested by insurers, platforms, or neighbors).
    • Local contact information for emergency response and complaint resolution.
    • Fire and life-safety equipment: smoke/CO detectors, extinguishers, posted egress info; comply with applicable building/fire codes.
    • If in a condo or HOA: written approval or confirmation that STRs are permitted under association bylaws.
  • Likely 2026 registration items (proposed; not yet codified)

    • Short-Term Rental Business License (if adopted).
    • Application fee capped at $150 for initial permit (Indiana HB 1035 limit).
    • Proof of adequate insurance (commonly $1 million liability minimum in comparable Indiana jurisdictions; confirm locally).
    • Background checks and property inspections may be included in a future registration framework.
    • Designation of a local contact person available 24/7.
    • Compliance with building, fire, and zoning codes.
    • If your property falls within a “conditional” zone under future zoning overlays, a conditional use permit might be required.
    • Expect quarterly tax filings through the Indiana Department of Revenue portal.
  • Documents to maintain for ongoing operations

    • Ownership verification, tax registrations, insurance declarations, inspection certificates, local contact details, guest logs and house rules, cleaning and maintenance logs, and tax remittance records.

Specific regulations for short-term rentals in Evansville, Vanderburgh County, and Indiana

  • City of Evansville

    • No dedicated short-term rental ordinance as of 2025; general business licensing and safety/nuisance rules apply. City maintains a separate Rental Property Registration for long-term rentals (Ordinance G‑2014‑29), unrelated to STRs.
  • Vanderburgh County

    • County lodging/innkeeper’s taxes typically apply to transient accommodations and are administered through the Indiana Department of Revenue portal. Rate and filing cadence should be confirmed with county/IDOR; general range statewide is 2%–10%.
  • State of Indiana

    • HB 1035/1036 prohibits municipalities from banning short-term rentals; caps initial permit fees at $150; permits local regulations for safety, zoning, and operational standards.
    • State sales tax of 7% applies to lodging under 30 days; state-administered local lodging taxes are filed through the same portal.
    • STRs are defined as residential units rented for fewer than 30 consecutive days across much of Indiana; Indianapolis and other cities adopt the same threshold.
  • 2026 outlook (proposed, not codified)

    • Anticipated introduction of a registration/licensing system, inspections, proof of insurance, and potential zoning overlays that categorize areas as permitted/conditional/prohibited.
    • Proposed density or saturation caps and guest registration requirements may be considered as the city formalizes rules.

Important note on timing and verification:

  • This guide reflects information available through mid‑2025. Because Indiana allows local governments to add or adjust STR rules, and Evansville may formalize a registration system in 2026, confirm any pending or new requirements with the Building Commission and the Indiana Department of Revenue before investing or launching. When in doubt, treat 2026 proposals as directional until they appear in the city’s ordinances or official guidance.

Overview of Evansville

Evansville is a city in and the county seat of Vanderburgh County, Indiana, United States. With a population of 118,414 at the 2020 census, it is Indiana's third-most populous city after Indianapolis and Fort Wayne, the most populous city in Southern Indiana, and the 249th-most populous city in the United States. It is the central city of the Evansville metropolitan area, a hub of commercial, medical, and cultural activity of southwestern Indiana and the Illinois–Indiana–Kentucky tri-state area, which is home to over 911,000 people. The 38th parallel north crosses the north side of the city and is marked on Interstate 69 immediately north of its junction with Indiana 62 within the city's east side. Situated on an oxbow in the Ohio River, the city is often referred to as the "Crescent Valley" or "River City". Early French explorers named it La Belle Rivière ("The Beautiful River"). The area has been inhabited by various indigenous cultures for millennia, dating back at least 10,000 years. Angel Mounds was a permanent settlement of the Mississippian culture from AD 1000 to around AD 1400. The European-American city was founded in 1812. Evansville anchors a regional economic hub based primarily on trade, transportation, and utilities; professional and business services; education and health services; government; leisure and hospitality; and manufacturing. Two NYSE-listed companies (Berry Global and OneMain Financial) are headquartered in Evansville, and three companies traded on NASDAQ (Escalade, Old National Bank, and Shoe Carnival) are also headquartered in Evansville. Evansville is home to Bally's Evansville, the state's first casino; Mesker Park Zoo and Botanic Garden, one of the state's oldest and largest zoos; and sports tourism industry. The city has several notable educational institutions. The University of Evansville is a private school on the city's east side, while the University of Southern Indiana is a larger public institution just outside the city's westside limits. The Indiana University School of Medicine also maintains a campus in Evansville. Other local educational institutions include the nationally ranked Signature School, the Evansville Vanderburgh Public Library, and the Evansville Vanderburgh School Corporation.
