| Step | What to Do | Why It Matters | |------|------------|----------------| | 2.1 Verify Zoning Eligibility | Confirm that the parcel is in a residential district (R‑1, R‑2, R‑3, R‑4) or a commercial district (B‑1, B‑2, CBD) that permits home occupations or lodging uses. | Short‑term rentals are treated as home occupations under Article XVIII, Section 1 of the Zoning Ordinance. | | 2.2 Check HOA / Landlord Rules | Review any covenants, bylaws, or lease terms that forbid transient rentals. | Even if zoning permits, a private restriction can block operation. | | 2.3 Obtain (or Confirm) a Building Permit | • If you plan structural changes (new entrances, fire‑escape, kitchen upgrades, etc.), file a building‑permit application with the Building Official.
• No permit is required for merely furnishing an existing dwelling, but any work over $1,000 must be permitted. | The Zoning Ordinance (Art. II, § 2) makes a permit mandatory before any construction or alteration. | | 2.4 Secure a Certificate of Occupancy (CO) | After construction (or before the first rental if you are using an existing dwelling), request an inspection and CO from the Building Official. | The CO is proof that the unit complies with the International Building Code and is safe for occupancy (Art. II, § 11). | | 2.5 Register as a Business & Collect Lodging Tax | • Apply for an Alabama Business Privilege License (state tax ID).
• Register for Alabama Lodging Tax (state 4 % + any local rate).
• File a Sales‑Tax/Lodging‑Tax Return each quarter. | State law (Alabama Code § 40‑23‑61) requires the collection and remittance of lodging tax on all short‑term rentals. | | 2.6 Purchase Insurance | Obtain a liability policy (minimum $1 M per occurrence) and property/contents coverage appropriate for a transient rental. | Required by most platforms and protects against guest injury or damage claims. | | 2.7 Set Up Guest‑Facing Policies | Draft a House Manual with quiet‑hour rules (10 p.m.–7 a.m.), emergency contacts, parking instructions, and local tips. | Aligns with the city’s general noise ordinance and improves guest satisfaction. | | 2.8 List & Operate | • Publish on Airbnb, VRBO, etc.
• Maintain cleaning protocols (hire vetted local cleaners).
• Monitor reviews and respond promptly. | Ensures compliance with platform policies and local expectations. | | 2.9 Ongoing Compliance | • Keep the CO current.
• File quarterly lodging‑tax returns.
• Conduct annual safety inspections (fire extinguishers, smoke detectors). | Failure to maintain compliance can trigger citations, fines, or revocation of the CO. |
